ICC finds Duterte fit to stand trial; proceedings set to open Nov. 30

THE HAGUE — The International Criminal Court (ICC) has ruled that former Philippine President Rodrigo Duterte is fit to stand trial, clearing the way for the opening of proceedings on Nov. 30, 2026.

Trial Chamber III made public the decision on Oct. 8, 2026. The decision was dated Sept. 28.

The Chamber said it was satisfied that Duterte is able to effectively exercise his fair trial rights. Its decision was based on the findings of an independent Panel of Experts, as well as submissions from the parties and participants in the case.

The Expert Panel unanimously found that Duterte has the capacity to understand the charges against him, the purpose and consequences of the proceedings, and the course of the trial, including the nature and implications of entering a plea.

The panel also found that he is able to understand the evidence and instruct his counsel in the preparation and conduct of his defence.

The Chamber also adopted measures to facilitate Duterte’s participation in the trial.

On the scheduling of trial hearings, the judges noted the Expert Panel’s recommendations and other submissions. The Chamber said it will assess sitting hours on a case-by-case basis, taking into account the individual circumstances of witnesses and the accused.

The Chamber further instructed the ICC Registry to ensure that Duterte’s health is continuously monitored by the Medical Officer of the Court’s Detention Centre.

Should the Medical Officer identify any changes in Duterte’s medical condition, the information must be transmitted immediately to the Chamber by the Registry under the appropriate procedures.

The judges will issue the schedule and directions for the opening of the trial in due course. Practical information, including how to attend or watch the proceedings, will be provided closer to the trial date.
